Terms & Conditions: Digital Products – Web Services

1. General Information

These Terms & Conditions govern the use of this website and the purchase of any digital products or services offered by Väike Studio (“the Studio”, “we”, “us”).

By accessing this website, purchasing a product, or hiring a service, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you should not use this website or purchase our products or services.

These Terms apply to all users, customers, and clients worldwide.

2. Digital Products – Design Templates

2.1 Product Description

Väike Studio offers digital design templates for use on third-party platforms such as Canva, WordPress, Wix, and Divi.

All products are delivered digitally. No physical goods are shipped.

2.2 License & Usage Rights

When you purchase a template from Väike Studio, you are granted a limited, non-exclusive, non-transferable license to use the product under the following conditions:

✅ You are allowed to:

• Use the template for personal projects

• Use the template for one (1) client project

• Customize the template (colors, text, images, layout) for your own use or for one client

❌ You are NOT allowed to:

• Resell, redistribute, share, sublicense, or give away the template, in whole or in part

• Use the same template for multiple clients

• Claim the template or any part of it as your own original work

• Sell, share, or distribute the template as a standalone product or within a bundle

Each template requires one license per client project. If you wish to use the same template for multiple clients, a new license must be purchased for each client.

2.3 Ownership & Intellectual Property

All templates, designs, layouts, graphics, and files remain the intellectual property of Väike Studio.

Purchasing a template does not transfer ownership or copyright to the buyer. Only the license to use the product as described above is granted.

2.4 Delivery & Access

Digital products are delivered via download or access link immediately after purchase (or as specified on the product page).

It is the customer’s responsibility to:

• download the files

• store them safely

• ensure access to the required platform (Canva, WordPress, Wix, etc.)

2.5 Refunds & Exchanges

Due to the digital nature of the products, all sales are final.

Refunds, exchanges, or cancellations are not available once the files have been delivered or accessed, unless otherwise required by applicable consumer law.

2.6 Platform Requirements & Compatibility

The customer is responsible for having:

• a valid account on the required platform (Canva, WordPress, Wix, etc.)

• any necessary subscriptions (e.g. Canva Pro)

• hosting and domain services, if applicable

Väike Studio is not responsible for platform changes, limitations, outages, or compatibility issues caused by third-party services.

3. Web Services

3.1 Scope of Services

Väike Studio offers web-related services including, but not limited to:

• website custom design

• website setup & maintenance

• technical support

• one-time consulting or configuration services

Each service is defined by its specific scope, duration, and deliverables as agreed upon at the time of purchase or engagement.

Any work not explicitly included in the agreed scope is considered out of scope and may require an additional fee.

3.2 Client Responsibilities

To ensure the proper delivery of services, the client agrees to:

• provide accurate and complete information

• grant timely access to required platforms, hosting, domains, and tools

• respond to requests and approvals within a reasonable timeframe

• ensure payments are made on time, when applicable

Delays caused by missing information, late responses, or lack of access may affect delivery timelines. Väike Studio is not responsible for such delays.

3.3 One-Time Services vs. Ongoing Services

Unless explicitly stated in writing, all services provided by Väike Studio are considered one-time services.

Ongoing support, updates, monitoring, renewals, or long-term management are not included unless covered by an active maintenance plan.

4. Domains, Hosting & Website Maintenance

4.1 Domain Ownership

All domain names must be registered in the client’s name or under an account created and owned by the client with the domain registrar of their choice.

Väike Studio does not retain ownership or long-term control of client domains unless an active maintenance plan agreement is in place.

4.2 Hosting Responsibility

Website hosting must be purchased and paid directly by the client.

The Studio may assist with hosting setup or website migration as a one-time service, but is not responsible for hosting renewals, payments, pricing changes, or account management unless explicitly included in a maintenance plan.

4.4 Maintenance Plans

If the client wishes Väike Studio to:

• manage domain renewals

• manage hosting renewals

• keep the website online

• perform updates, backups, or technical support

an annual maintenance plan must be purchased.

Without an active maintenance plan, Väike Studio does not assume responsibility for:

• service renewals

• website downtime

• suspended hosting

• expired domains

• loss of access or data related to missed payments

4.5 Expiration Notices

The Studio may send renewal reminders as a courtesy.

However, the final responsibility for monitoring expiration dates and completing renewals remains with the client. Väike Studio is not liable for issues resulting from expired services.

4.6 Website Migrations

Website migrations to a hosting provider or registrar chosen by the client may be offered as a one-time service.

After migration, all management, billing, and responsibility remain with the client unless otherwise agreed in writing.

5. Third-Party Services, Platforms & Affiliations

5.1 Use of Third-Party Services

Väike Studio products and services may rely on or integrate with third-party platforms and services, including but not limited to:

• Canva

• WordPress

• Wix

• Divi

• hosting providers

• domain registrars

• plugins, themes, and other external tools

The use of any third-party service is subject to the terms, conditions, pricing, policies, and availability established by those third parties.

Clients are solely responsible for reviewing and complying with the terms and conditions of any third-party services they choose to use.

5.2 No Affiliation Disclaimer

Väike Studio is an independent design studio and is not affiliated with, endorsed by, sponsored by, or officially connected to Canva, WordPress, Wix, Divi, Hostinger, or any other third-party platform or service mentioned on this website, unless explicitly stated otherwise.

All third-party product names, logos, trademarks, and brands are the property of their respective owners and are used for identification and compatibility purposes only.

Väike Studio has no control over, and assumes no responsibility for, changes in functionality, pricing, policies, availability, performance, or limitations imposed by third-party services.

5.3 Affiliate Disclosure

Some links, discount codes, or recommendations shared by Väike Studio may be affiliate or referral links. This means that, at no additional cost to the client, Väike Studio may earn a small commission if a purchase is made through those links or codes.

For example, Väike Studio participates in some affiliate programs and may provide referral links or discount codes (such as promotional discounts on hosting services) as a benefit to clients.

Any commissions earned through affiliate programs do not increase the price paid by the client and help support the operation, maintenance, and development of the Studio.

Participation in affiliate or referral programs is optional, and clients are under no obligation to use any recommended third-party service. Väike Studio may participate in additional affiliate or referral programs with other platforms in the future.

All recommendations are made in good faith based on compatibility, experience, and general suitability, but the final decision and responsibility for choosing and using any third-party service remains with the client.

6. Intellectual Property

All content, designs, templates, layouts, graphics, text, and materials provided by Väike Studio remain the intellectual property of Väike Studio, unless otherwise stated in writing.

Clients are granted a limited license to use purchased products as described in these Terms & Conditions. No ownership rights or copyrights are transferred.

The Studio reserves the right to showcase completed work in portfolios, case studies, and marketing materials unless otherwise agreed in writing.

7. Limitation of Liability

To the maximum extent permitted by law, Väike Studio shall not be liable for:

• any direct, indirect, incidental, or consequential damages

• loss of profits, revenue, data, or business opportunities

• website downtime, service interruptions, or technical failures

• issues caused by third-party platforms, services, or providers

• client misuse or modification of templates or websites

The use of all products and services is at the client’s own risk.

8. Termination

Väike Studio reserves the right to terminate or suspend services if:

• the client breaches these Terms & Conditions

• required payments are not made

• access to necessary platforms is not provided

• communication becomes abusive or unreasonable

Upon termination, any outstanding balances remain payable. Access to services or files may be limited or revoked as applicable.

9. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.
